These General Terms and Conditions ("GTC") constitute the legal framework for the use of the website zincutec.eu and for all contracts between ZinCuTec GmbH, Siemensstraße 9-11, 72622 Nürtingen (hereinafter "ZinCuTec") and the buyer.
ZinCuTec offers goods via an online shop on the website https://www.zincutec.eu/shop/. The following GTC apply to both consumers and businesses. The customer must confirm before ordering that they have expressly acknowledged the GTC.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. Deviating conditions of the customer are only binding if they have been acknowledged in writing.
All prices quoted are in euros including the applicable statutory value-added tax. Shipping costs apply only to dining tables. The following payment methods are available: bank transfer, PayPal, credit card (Visa, Mastercard), instant transfer / Klarna, Google Pay / Apple Pay.
The products displayed in the shop do not constitute a legally binding offer, but a non-binding invitation to place an order. By submitting the order, the customer makes a binding offer to conclude a purchase contract.
When paying by bank transfer, the purchase contract is only concluded upon dispatch of a separate email with an order confirmation or delivery of the goods. When paying via PayPal, Google Pay/Apple Pay, credit card, or instant transfer/Klarna, the contract is concluded upon the customer's payment instruction.
Unless otherwise agreed, delivery is made from our warehouse to the delivery address specified by the customer. Shipping is via DHL or freight. The delivered goods remain the property of ZinCuTec until full payment of all claims arising from this contract.
The stated delivery times are non-binding unless a binding delivery time has been expressly agreed. Delivery times are typically 5–6 weeks. During summer months and winter holidays, delivery may take 7–8 weeks.
For deliveries to non-EU countries, additional costs such as customs duties, taxes, or money transfer fees may apply, which are to be borne by the customer.
For consumers, the risk of accidental loss and accidental deterioration of the sold goods in a mail-order purchase passes to the consumer when the goods are delivered to them.
ZinCuTec delivers within the Federal Republic of Germany (mainland only) to the kerbside. DHL parcels and standard freight ship free. Dining tables are delivered by freight for €450. This applies to Germany and the international delivery countries available at checkout.
Unless otherwise agreed in the GTC, the statutory warranty rights pursuant to §§ 434 et seq. BGB (German Civil Code) apply. The customer is obliged to check the goods immediately upon receipt for completeness and defects.
The products are made of patinated copper, burnished brass, oxidised aluminium, and stainless steel. The surfaces develop individual colour nuances through natural oxidation and may show irregularities. These properties do not constitute a defect but give each piece its unique character.
If transport damage is visible, ZinCuTec requests notification to shop@zincutec.eu within 24 hours.
The liability of ZinCuTec for contractual breaches of duty and tort is limited to intent and gross negligence. This limitation does not apply to injury to life, body, or health of the customer, or claims due to breach of cardinal obligations.
The processing of personal data is carried out in accordance with the GDPR and the BDSG (German Federal Data Protection Act). Detailed information can be found in our privacy policy.
The law of the Federal Republic of Germany applies. The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply. Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
